In a Pinch Picture – Terms & Conditions

Please read these Terms & Conditions carefully. By booking services with In a Pinch Picture, you agree to be bound by these terms.

1. Services Provided:

In a Pinch Picture (“we,” “us,” or “our”) offers professional photography and videography services, including:

Candid Photography

Wedding Films

Traditional Photography

Pre-Wedding Shoots

Albums

2. Booking & Payments:

Booking Confirmation: All bookings require a signed agreement and a non-refundable retainer fee to secure your date(s). Dates are not reserved until both are received.

Payment Schedule: The remaining balance for services will be due as per the payment schedule outlined in your specific service agreement.

Late Payments: Invoices not paid by the due date may incur a late fee.

Cancellations:

If you cancel your booking, the retainer fee is non-refundable.

If you cancel within a specified period (as detailed in your agreement, typically 30-60 days) before the event date, an additional cancellation fee may apply.

In the unlikely event we need to cancel, all fees paid will be refunded.

3. Creative Control & Deliverables:

Artistic License: You acknowledge that we retain full artistic license and discretion in the shooting, editing, and final production of all photographic images and video footage.

Deliverables: The number of final edited images, length of films, and album designs will be specified in your service agreement. Unedited RAW files or footage are generally not provided.

Delivery Timeline: We will provide an estimated delivery timeline for your final products (photos, films, albums) in your service agreement. While we strive to meet these deadlines, minor delays may occur due to unforeseen circumstances.

4. Copyright & Usage:

Copyright: In a Pinch Picture retains the copyright to all photographic images and video footage created.

Client Usage: You are granted a personal, non-commercial license to reproduce, print, and share the final delivered images and films for personal use (e.g., social media, personal prints, sharing with family and friends). You may not sell, license, or use the content for commercial purposes without our express written permission.

Promotional Use: Unless explicitly agreed otherwise in writing, you grant In a Pinch Picture the right to use selected images and video clips for our portfolio, website, social media, and other promotional materials to showcase our work. If you prefer your content not to be used for promotional purposes, please inform us in writing prior to your event.

5. Client Responsibilities:

Cooperation: You agree to cooperate fully with our team to ensure a smooth and successful shoot.

Access: You are responsible for ensuring we have adequate access to all necessary locations for photography and videography.

Safety: You are responsible for ensuring a safe working environment for our team.

6. Limitation of Liability:

In the rare event of equipment failure, injury, or other unforeseen circumstances preventing us from fulfilling our services, our liability will be limited to a refund of all fees paid for the affected services. We are not liable for any consequential damages or losses.

7. Force Majeure:

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, war, terrorism, epidemics, pandemics, government regulations, or natural disasters.

8. Governing Law:

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, and any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts in Jodhpur, Rajasthan.
